The FCO Inc. has falsely represented itself to Concert as an entity that can abdicate, give up, their Community Services Customers (11 Associations) Property Rights when approving the Cooperative Agreement.

Why CGP would even entertain entering an Agreement with the FCO, who assertedly, has repeatedly defaulted on Property Management Agreements with its own member Associations over the last decade, is beyond rational comprehension.

The FCO BOD by partnering with CGP is guilty of, but not limited to, the following conflicts of Fiduciary Duties, as cited above, for the following.
• Receiving Future unrestricted cash payouts;
• Assuming Future Liabilities for which they have no ability to assess or collect assessments from anyone;
• Assuming future liability for “Brown Field” conditions on or under property accepted as a condition of the Agreement;
• Assume Maintenance, Cap Ex and Insurance Costs on all structures and equipment acquired under the conditions of the agreement;
• Assume Hazmat remediation of Structures/Buildings on Assets acquired from CGP under the Agreement;
• Assume Maintenance, Cap Ex, Insurance, signage, lighting, stripping, Security patrolling, etc. on all private roads acquired under the conditions of the Agreement;
• Assume Right-of-Way Agreements granted by CGP to member and non-member Associations; since acquiring all Not-for-Profit FCC assets;
• Employ extortion, i.e., Disable vehicle Bar Code Access, Halt Community Security, Cancel D&O Insurance, etc.;
• Redirect community budgeted and allocated Road Improvements and Building replacement Cap-Ex funds to FCO CD’ and identify interest as income;
• Use Redirected Cap-Ex CD Interest for operations;
• Operate outside the Articles of Incorporation;
• Etc., Etc.;

I have sent the following email to the presidents of those courts not allowed to vote when the FCO considered the agreement with Concert.

By now I suspect you all know that Concert has finally filed plans for development of Parcel E (the driving range area, the clubhouse, and golf holes #1,3,4,5,15,16,17, and 18 of the West golf course). The submitted plan calls for 156 townhouses and 194 single-family homes with 21 units devoted for work-force housing. The proposal calls for a change to the area’s Master Plan and a re-zoning to a Planned Unit Development (PUD), such action would result in at least one public hearing held by an agency of the county.

At its December meeting, the FCO Board of Presidents voted not to oppose development plans on Parcel E (without even seeing such plans) in consideration of receiving $7,500 per approved building unit. Versailles Court, Plaza Court, and the Townhouses voted against such proposal, and significantly your courts were not allowed to vote at all.

You also may have heard that Brian Flores has sent a memo out to “member” courts indicating that the plans have been filed and that Versailles Court has received a 60-foot buffer throughout as it has requested. This memo is in error. Versailles Court asked for a buffer area of not less than 75 feet. Concert/Ridgewood offered a plan showing a 50 foot buffer and stated that they could not achieve 75 feet without reducing the number of included units. When Versailles indicated continued unhappiness with this plan, Concert/Ridgewood stated that they could probably provide 60 feet but would have to make changes to the plan shown. Versailles replied that we could not comment on the plan without seeing it. And, we still have not seen it, as the proposed plan does not provide a 60-foot buffer throughout particularly at the west-end of the court.

Besides the obvious negative effect the plan would have on Versailles Court and Plaza Court, the addition of 350 housing units within the confines of the original Fountains of Palm Beach would over tax many of our facilities. Most affected would be the roadways in the northern portion of the community (where many of the disenfranchised courts are located). Currently, the exit onto Lake Worth Road is disfunctional; the addition of the resulting traffic from the new units, would sorely exacerbate the situation. Entering the Fountains from either the west or the east at peak times backs up into traffic lanes creating a dangerous situation. Exiting the Fountains and trying to make a left turn onto Lake Worth Road has cars queuing beyond the gates and taking up to three traffic lights to complete the turn. The county has indicated that Fountains Drive from Lake Worth Road through to the Melaleuca Gate cannot handle the additional traffic without modification.

The plan calls for creation of a congested area of two-story townhouses. There are 81 such units shown in the area now occupied by the clubhouse and cart barn (directly across the road from Gefion and directly abutting Plaza Court).

Much of the attitude within the Fountains has been: “it’s Concert’s land and they can do what they want.” In reality, as residents of the county we do have the opportunity to comment and possibly effect changes to the plan. Lucerne Lakes, next to us on the west, successfully had the building units to be constructed on the Forest Oaks golf course reduced from 450 to 325. I am hoping that others besides Versailles Court will join in the efforts to control this development. Please consider doing so.

Hi GK, The Fountains Condominium Operations (FCO) has a comprehensive master email distribution list for all Fountains residents. It may not be up to date since 9 Courts are no longer managed by Brian Flores, CAM & property manager. I seriously doubt he would be willing to send out a Fountains-wide communication regarding the Blog, or to re-post Gene Strum’s comment. The FCO Board of Directors voted 8-3 in favor of granting Concert to build 350 homes on Parcel E, so I doubt they would direct Brian Flores to help in any way.

8 Voted in FAVOR: Cathy Widdoes (Luxemburg #03), Bernie Ciancanelli (Oakmont), Roberta Monahan (San Marino), Ken Kures (Parisian), Ivan Menschel (Marseilles), and the Presidents of Valencia 3A, Valencia 3B, Valencia 3C.

The FCO Board did NOT allow the eight (8) GRS Courts to vote: Gefion #01, Trevi #02, Esedra #04, D’Este #05, Tivoli #07, Milan 1 #11, Milan 2 #12, and Atrium Homes #17.

The Fountains at Lakeshore (Court #20) did not get a vote either.
